Legal Question in Family Law in Georgia

My husband and I have been married 30 years. Have been separated 4 years. He has been allowing me to have one quarter of his income. I am disabled and unable to work. Am in a community property state. Shouldn't I be getting half of the income?

Georgia isn't a community property state. However, it appears you might be entitled to permanent support. Moreover, Georgia is an equitable property division state. As a result, you might be entitled to 50% (more or less) of the marital property.

Georgia is NOT a community property state. Your husband has no duty to give you anything at all, unless you file a court case for divorce or support. If you do, it is up to the court to decide what amounts of alimony, and what property settlement, you may receive.
