Legal Question in Civil Litigation in Georgia

College Delimer

My son goes to the Art Institute of Atlanta.The school does not have have facilities for living on campus,but is affiliated with Metro Pointe lofts who provides living quarters for the students.About a month ago,my son woke me up about 2.00AM complaining that another student in the facility is threatening to beat him up.The kid followed him to the gym where he was working out and asked my son if he was traning to fight him.There were other instances where my son said he just walk away.My son is scared of the kid and is afraid to report it for fear that the kid will thing he is snitching.Two weaks ago the kid told my son he is moving in with him in the same apartment.I alerted the staff of the facility and had my son spoke to a gentlyman who said he was responsible for assigning rooms and he was not aware of that situation.Anyway he assured me,after i layed out the circumstances to him that he will take care of it.On April 26th my son told me that the student moved in to his apartment.I spoke to the same gentleman who now says he can,t do anything about it because my son did not complain again.My son said that this kids smoke weed and when he gets high he looks for trouble.Could i take any legal action.

You failed to address the most obvious solution - your son can move. You also fail to address another important issue - the terms of any rental or lease agreement. Without addressing those issues, you don't state the basis for any lawsuit. It also appears your son is afraid to take steps, and is simply willing to live with the issue. A lawsuit will not fix that issue. Finally, if there are drugs being used in the apartment, or kept there, your son should get out ASAP for that reason alone. The police or school officials may not spend too much time figuring out who was doing what in the apartment.

If the kid threatened to beat your son up, your son can bypass the school and file a police report with the Atlanta Police or Fulton County Police (whichever one has jurisdiction).

All too often schools tend to sweep these things under the rug. So, going to the police may resolve this faster than waiting for the school.
