Legal Question in Civil Litigation in Georgia
homeowners association
Our HOA raised our fees 45% the covenents say that they could be raised 5% without a vote of homeowners. They have not been raised in many years, and the Board thinks they could go back retroactively.

Re: homeowners association
I represent HOA's, as well as homeowners against their HOA's, as long as there is no conflict of interest. Your situation will likely be governed by your covenants and/or bylaws. You should consult with an attorney familiar with this area of the law.

Re: homeowners association
You did not ask a question. We do not know exactly what your contracts say with respect to this issue, or contesting an action. Get other homeowners together as a group to discuss it and address the board.
