Legal Question in Civil Litigation in Georgia

House not build to plan.

In June 1999 a contractor started construction of my new home, who sub-contacted it out to 2nd party who sub-contracted it to the 3rd party who sub-contracted it to the 4th party. Ater countless mistakes to the floor plan and extemely poor workmanship. The home was 95% complete in December of 1999. After about 2 months of living in the home, things started to bow and brake. I had a building inspector check the home and he found 2 pages of things wrong that were no where near code. The biggest concern to him was that the home was 2 feet short in lenght and width, according to the floor plan. The contractor will not answer my letters or phone calls. What can I do from a legal direction?

Re: House not build to plan.

Thanks for your inquiry. You may have a right to sue the contractor and/or subcontractors for the defective construction. Your rights may be dictated in the contract (e.g., warranty provision). You may also have additional rights to sue the contractor or subcontractors under statutory or common law claims.

A review of your contract and all other correspondence is necessary to determine your specific rights in this situation.

The period in which you may sue will be limited. Should you wish to pursue this claim, you should speak to an attorney immediately.

Please feel free to call if you have any further questions. 770-640-6558.
