Water Damage Possible Mold

I have live in an Apartment with a 13 month lease. Move in date was May of 2006...Full depost was given...monthly payments have been made on time. Water damage started and old black mold has been painted over in the 2nd bedroom and bath. I have a chance to move into a home...and asked the apt complex what the fee would be.....it came up to over 1200 plus I would lose the 820 given as a deposit. They have painted over the water damage but the stains and god only knows what kind of mold is growing....I have been having ears, nose problems from the time that I have moved...Is ther anything that I can do to get them to let me out of my lease?....without the large 1200....they can keep the deposit at this point....I just want out!!!!

Because your landlord is asking for a large sum of money, you may want to pay to sit down with an attorney for an hour or so, in order to obtain an informed opinion. An attorney will want to see your lease and other records such as correspondence and notes of telephone calls.

You lease should tell you how much you will have to pay, and what steps you must take with respect to notice, for early termination. You do not tell us what it says, or whether you are month to month since you say you moved in well over 13 months ago and have a 13 month lease. As far as he mold, that MAY be an issue, but you do not provide any information about your efforts to provide them notice of the problem and their efforts to fix it, and how long you lived with it before you decided you want to leave. Apartment managers are used to such issues coming up suddenly when the tenant would like to leave without penalty.
