Legal Question in Wills and Trusts in Georgia

Father died without a will.

Father had no will. Do adult children have rights? Stepmother is giving his property to her child from a previous marriage. What can we do?

You definitely have rights to a portion of your father's property. Consult with a local attorney.

Re: Father died without a will.

When a person dies without a will, his or her assets are distributed in accordance with state law. In Georgia, the assets would be shared by a spouse and children, in accordance with GA law. Here, it is likely that you, your natural siblings, and your step-mother would share in the inheritance, if any.

In response to your question of "What can we do?" you may petition the probate court for a portion of the estate. You may want to consult with a local attorney to obtain advice specific to your situation and then determine whether this is something you can pursue on your own or if you should have counsel represent you.
