My father passed away in 1968 when I was 2. Me and Mom are the only heirs. His insurance paid off our home. My Mother completed a 12 months support at the Court house and thought that was all that needed to be done. When we went to get a mortgage last year, they mortgage company did a title search in both our names and called us scratching their heads and asking for a copy of our title. The only one we have still lists my Father. The mortgage company said that we needed to get the title in one or both of our names. I went to the court house to inquire about this process and they told me that they couldnt handle that and I would have to get a lawyer. Im confused. What do I need a lawyer to do exactly?

You have learned a couple of lessons here. The first, and most people don't know this, is that the folks at the courthouse are NOT (REPEAT: "NOT") supposed to give legal advice.
The second is that some mortgage people are lazy. They have lawyers by the boatload. This should be a simple matter of getting an attorney to draft the required documents. If they won't do it, consult with a local attorney.

That is a question for the lawyer you retain. You have a 30 year old problem and say you are "confused" and do not know what to do, so that is why you need the lawyer.

You need a lawyer to look at the paperwork and find what steps you missed being your own lawyer. He can likely draft corrective documents and record them.
