If an employee gets hurt on the job and is released to come back with light duty but the department she works for can not accomidate the light duty, can she work in this companys workers comp department to accomidate the restrictions?

If the worker has been released to light-duty, and if the employer is not making suitable light-duty work available to the worker, the insurer should be paying temporary total disability benefits to the injured worker. The employer can make a light-duty job available in another department. As long as it fits within the physical limitations of the injured worker, the worker would not be entitled to temporary total disability benefits. If the injured worker does not earn as much money in the light-duty position as he/she earned in the regular job, the worker would probably be entitled to temporary partial disability benefits. If the employee is currently receiving workers' compensation income benefits, the benefits may not be suspended until the authorized treating physician has signed a light duty job description. There are other requirements as well contained in Board Rule 240.
