Legal Question in Criminal Law in Idaho
time served applied to sentencing
I was arrested and in jail for a month then sent to a State Mental Institute for 6 months. If found guilty there is a two year mandatory minimum. I know the month jail time is considered time served, but will I or can I get credit for the 6 months the state had me commited to the hospital?.

Generally yes but the Court does have discression. Since you are facing time, I assume you either have an attorney, can afford one, or are elgible for a public defender-- they are the person to ask about your particular circumstances.
