Legal Question in Business Law in Illinois

Non Solicitation

I signed a non solicitation agreement in 2005. Since that time the company name has changed, and they did not use my legal name on the agreement, which was part of the employment offer. The salary, and benifits are no longer accurate as the salary was reduced, and the benifits were taken away. Is this document still valid?

Re: Non Solicitation

It all depends on the content of the contract as written. I cannot comment further without reading the agreement.

Re: Non Solicitation

None of the factors you mention would automatically cause the non-solicitation agreement to be invalid. For example, a mere name change by a company does not invalidate its existing contracts. In the same vein, if the contract names you as "Barney Jones" and your full legal name is Barnabas Ignatius Jones, that will not cause the contract to fail.

The only way someone can tell you whether there are arguments that the agreement is unenforceable is to review the entire agreement and discuss the facts in detail with you.
