Legal Question in Consumer Law in Illinois
While driving a Hertz rental car in the Chicago suburbs, I picked up a red light violation. Hertz charged me a $30 “administrative” fee for sending the violation notice to me, and they refuse to refund this (they did not have to pay the violation, I took care of it.) Do I have a small claims case here? The money is not the issue, it’s the principle. I cannot believe Hertz ran up $30 in expenses looking up the rental record and mailing the notice to me.

Step one would be to review your contract with them. You may have agreed to this fee when you rented the car. It also is possible that you agreed to resolve any disputes through arbitration rather than being able to sue them. Assuming you can sue them, it will cost you a couple hundred dollars in filing service fees, and you should plan to spend a fair portion of a couple of days at your local courthouse for the initial appearance and trial.
