Legal Question in Entertainment Law in Illinois

A waiver for motorcycle stunts in a parking lot.

I need to make a waiver. The CEO of the company I work for gave a few friends and myself permission to practice motorcycle stunts on his property. My friends and myself want to practice in a more safe inviroment and keep it off the street. I want a waiver to protect him from being liable if anyone gets hurt. What I need to know is do I have to have a lawyer write up a waiver or can I do it myself? If a lawyer is not necessary, what needs to be listed on the waiver in detail to make it valid? If a lawyer is neccesary are documents that can be purchased over the web valid? Or would it be just as cheap to talk to a lawyer in my area? This may sound like a weird request, but we and many others are trying to make this a new mainstream sport. This sport when it hits the mainstream will be similar to the X-games extreme motocross events aired on ESPN. The activities that we will be practicing include many variations of wheelies, endoes, acribatics, and burnouts. Any help would be great.

I would think your boss might want to have an attorney prepare or look over any waiver you provide, since he's the one in trouble if the waiver is unenforceable. It's really up to him. If he's ok with you preparing some kind of waiver which may or may not protect him, why not?

I take that these types of stunts and what not are not somehow part of the company you work for? I ask because it could open a whole host of agency issues.

Anyway, it's really him that needs an attorney to draft this limitation of liability. Even with this agreement he could still be open to some liability. As an invitee, he'll still have some duty to insure that the property is free of hazards.
