Legal Question in Family Law in Illinois
child custody/restraining order
my stepson just lost custody of his 2 boys. His ex was able to hit him with a ''bogus'' restraining order...though he wouldn't hurt a flea...and she had some young neighbors jump him for heaven's sake and turn it around and make my stepson look like the bad guy. Anywho...he has visitation which begins this evening...but if he has a restraining order that he cannot get within 500' of his ex and cannot call her...how does he physically pick the kids without violating this order? Does someone else have to pick them up for him? Or is this an exception when picking up and dropping off the kids?

Re: child custody/restraining order
If things were drafted properly, the Order of Protection should spell out specific visitation provisions. As long as this is in the same document that also doesn't allow him to be near the wife I think he'll be okay. Is it a 2-year Order of Protection? There still may be time to get out of the O.P.
