Legal Question in Family Law in Illinois

I have a daughter who will be 3 in May. I'm wanting to change her last name from her father's to mine. He has signed the affidavit and so have I. I sent everything in after getting it notarized. I have yet to hear anything back from the state of Illinois. My reasoning for this change is her father doesn't see her, he pays child support but hasn't tried to see her or seen her since before she turned a year old. She has no memory of him, she's getting older and going to be starting pre school soon. I would just rather her have the same last name as me, before she starts asking questions on why she doesn't have the same name as mommy. Less confusion for her, the better.

If he agrees, you can do it. If the records people will not do it, you need to file a Change of Name action.
