Legal Question in Civil Litigation in Illinois
My father recieved a settlement on a workmans compensation lawsuit (about 40,000) this year. He transferred the money (about 30,000) to his son. My father went into a nursing facility soon after. My brother took most of the money and invested it into trust funds for his two nieces. My brother is now being investigated by the Dept of aging for the money. Social Security is refusing to assist in financial care for my father based on this money he had. I personally reciecved 3,000 of the money which I spent on bills. My sister also recieved about the same amount of money and used it for bills. The rest paid for my father's stay at the nursing facility. What I want to know is my brother legally responsible for my father's nursing home care? Can my brother (or any family member) be billed or charged with any wrong doing?
