Legal Question in Employment Law in Illinois

My manager put me in PIP within a few months of a new job and after the 90 day period - she fired me. the PIP was based on my ability to make presentations and speak clearly. She focused on the negatives only never included positive remarks. I completed a 360 and everyone gave me good remarks except for my manager. I feel that this process was unfair and subjective.

In Illinois your employer does not need a reason to fire you but some companies have created a "process"(PIP) they follow if they are planning to terminate someone. Often the contents of a PIP are subjective. If your supervisor is undertaking this action BECAUSE you are in a protected class (race, color, religion, national origin, sexual orientation, marital status, medical issues) then you might have an actionable claim. Otherwise, as stated in the beginning of this answer, your employer does not have to even go through a PIP by law before they fire you. Another reason employers utilize PIPS is to fight an employee's application for unemployment. Here the employer must show one of two things if they are to prevent you from getting unemployment when they fire you: misconduct in connection with your work or a felony in connection with your work.
