Legal Question in Employment Law in Illinois
restriction of trade?
As a physician specialist and an employee of 3 years of a large healthcare
corporation, i was stongly 'encouraged' to agree to hiring a partner that i did not
need or want. He is a friend of the pres. of our group (150+ docs). In 6 mo he
has surpassed my productivity and is slowly taking over my practice with the
help of administration. Our referrals are to be unbiased, however upon
speaking to some of the refering docs (who have been extremely loyal to me
over the years), they say that they were told by administration to send their
referals to my partner and not to me to make him busy. I am fending for myself
as there is no one to back me, but my practice is suffering. Is there any
restriction of trade or employment dicrimination here ? (Of course there is
much more to it than this....)

Re: restriction of trade?
Obviously, there is more to the story than you have been able to convey. Are you over 40? Close to retirement? You may have the basis for an age discrimination if your answer is yes to either question. Is your "partner" younger? Are you a member of a protected class (minority group, religious minority, etc.)? These questions are critical to the assessment of your case. However, I would document as much of the situation as possible. To the extent you are able to obtain written confirmation of your suspicions from third parties the better. I have indepth experience in the representation of physicians in situations such as yours and would like to speak further about your situation.
