Legal Question in Personal Injury in Illinois
I was involved in an accident and the other driver was ticketed. I was injured and I want to know if I would be entitled to punitive damages.

Why, because a ticket was issued? No that on its own is generally not a justification for punitive damages. In fact a ticket conviction may not be admissible if the ticketed driver shows up and attempts to beat the ticket. If there are other circumstances why punitive damages may be available, you have not stated as such. Otherwise it may only be admissible in a subsequent civil trial if the ticketed party fails or refuses to show for trial and is convicted of the offense and then only "may" help prove that driver's negligence.
Most likely you are not entitled to punitive damages unless the other driver drove his car into yours on purpose or he was drunk or something like that-otherwise, punitive damages are not going to be on the table for you.
But, you are entitled to compensation for your medical bills, pain & suffering, loss of normal life, any wage loss you have incurred, any out of picket expenses and your property damage and car rental expenses. If you need help in finding out how to go about getting proper compensation for your injuries, you may contact my office.
I hope this helps-
You are not entitled to "punitive" damages. You may be entitled to any medical bills resulting from accident paid, loss of income from accident and pain and suffering. Consult with an attorney before making statements to the insurance co.
