hi my name is leontyne walker , and back in december of 2009 my girlfriend was driving my car and i didnt have insurance there was no court date or anything sent to me my car was total out another car hit my car and now there sending me a letter saying that it was her fault but how can they say that when my car was total out my girlfriend side was not even heard and all this is thur his insurance company no lawyer or nothing she was knock on conscious and taken to the er now i know i didnt have insurance but can they say its my fault with only hearing his side should i get a lawyer or am i out of luck but its his fault and i think both side of the story should be heard he even told the police that he was trying to slow down but could not what should i do from here.

You need to speak with an attorney immediately. If they get a judgment against you, they can then garnish your wages or attach your bank account and collect the judgment plus cost of the lawsuit.

You should hire counsel as it does sound like there is a valid defense to what happened and you could have some majore problems if the situation is not addressed as soon as possible. It is also possible that your girlfriend has a case against the other driver.
