Legal Question in Wills and Trusts in Illinois

Child from previous relationship

My husband has a child from before we were married. He has never paid support, his name is not on the birth certificate, we do not even know where the child is living currently or the mother. They were both young when she got pregnant with the girl and drifted apart shortly before she was born. We are getting ready to do an estate plan and we have two boys together, can this other child come back after my husband dies and claim a share of his estate?

Yes, unless your husband properly disinherits the child.
