Legal Question in Wills and Trusts in Illinois

father's death

My father died Sept. 17, 1998. I was 17 and in H.S, yet; was I not informed by the family due to lost contact. After H.S I attended college and still currently attend. My question is, should I have recieved money from my father's death, and is that money still waiting for me?

Re: father's death

It depends on whether your father's estate had assets and if so, what he specified in his will, if he had one. If he had no assets in his estate, then no notification would have been required. However, if he had assets in his estate (i.e. in his name alone), then you should have been notified if any of the following were true: 1) If the estate exceeded $50,000, 2) If you were named in the will, or 3) If there was no will.

You can check with the clerk of the court in the county where your father lived to find out if a will has been filed and/or a probate estate has been opened.
