Legal Question in Workers Comp in Illinois

When Does Workmen's Comp End

My husband just got done with his last docotor's visit and has been getting workmen's comp since September 27 of last year. He is starting a law suit against his temp agency. He would like to know when will he stop getting his workmen's comp payments.

Re: When Does Workmen's Comp End

Your question is not really clear but if you provide more details I will be able to more completely answer your question.

Worker's Compensation does not really "end".

The insurance company must pay TTD (temporary total disability) benefits as long as you are restricted from work.

If by "just got done with his last doctor's visit" you mean the doctor released him from his care without restrictions, then there is no "disability" - so there are no temporary total disability checks.

If the doctor also found that your husband is at "maximum medical improvement" then you can choose to settle your case and "end" the claim.

Many people do not know, nor does the insurance company tell them that they have a right to recovery for the permanent aspect of the injury.

If your husband has been off work for more than one year, I would suggest that you contact a lawyer because he may be entitled to more benefits than you realize.

If your husband was released with permanent restrictions then you realy must hire a lawyer because he may have the right to collect some form of benefit for rest of his life.

Let me know if you have any more questions or need more assistance.

Re: When Does Workmen's Comp End

Worker's Comp. payments end when you husband is released (medically) to return to work. So my guess would be now.
