Legal Question in Family Law in India

Sir,

I have been struggling for many years for my divorce, i m christian and my marrige was arranged, took customary divorce within 2 months of marriage. My divorce petition u/s 10 of indian christian divorce act has been decided with rejection due to not proper pleading and not mention customary divorce in petition but showed in the rejoinder with evidence, now i have filed CPC 7(1)B for declaration since i was divorced by customary way on stamp paper. 7(1)B suit is still pending. But i was told by the HC Adv. to appeal under delay conden on the previous suit u/s 10 which was rejected. My question is can i appeal in HC can it get approved for delay condon?

You will need to explain each days delay, as delay is not condoned fro asking. Hence you must be in a position to establish that delay was caused, although you were diligent.
