Salary not paid

I have been working for an IT company and they haven't paid my salary for 5 months starting from May 2008- Sept 2008. And the owner says he is bankrupt and is unable to pay. Many of colleague have left the co. due to irregular payment. I have joined a new co. but I cannot afford to leave this money. What possible action can I take? Kindly advise. Thank you

You can file a money suit in the civil court. However, if bankrupcy proceedings are initiated, against the employer then in that case, you will have to approach the district court, wherein such proceedings are initiated.

If you comes under "worker" then go to Labour Court for payment of wages, otherwise go to Civil Court for the recovery of amount (salary).
