cell phone bill

On October 11, 2002 my cell phone bill showed a pymt of

$5490 which I did not make. I contacted the company on this

and was told they would investigate and respond and that I

did not need to worry about making my payment. This

continued for several months. I called and visited my local

store several times and was told they didn't know why this

credit was on my bill and not to worry about it. I asked

several times as to making my payments and was told ''you

don't need to worry about it''. After one year my bill

suddenly shows a reversal of the credit and they insist I

owe for the past year NOW or the phone will be shut off.

Not once did anyone ever respond in any manner to my alerts

to their billing error. I realize I should have probably

continued to make my monthly payments, but was told

repeatedly not to worry about it. They refuse to negotiate

with me and insist that I must agree to pay over $400 NOW

and agree to a new monthly plan that would cost me over $125

per month which I can not afford to do. What rights do I

have when they made the error and never respon

For anything involving utility companies, the consumer is pretty much screwed as far as private remedies are concerned. Probably your best bet is to grieve to the Federal Communications Commission, tell the cell phone company that you are filing the complaint, and see if they will hold your situation in abeyance. Also, in a few weeks you will be able to transfer you phone number to a new carrier (though there is probably some requirement that old bills be paid.) Here is the website for FCC complaints.
