Legal Question in Credit and Debt Law in Indiana

Running a Credit Check without consent

My Husband and I were looking to buy a new car and I went alone one day to test drive at a dealership. I really liked the car and the salesman wanted to go ahead and get some of the paperwork filled out so all my husband had to do was come in and sign and everything else would be filled in already. I told him specifically that I did not want anything ran through the credit bureau until I had spoken with my husband, he noted this on the paper in front of my eyes that ''subject to Husbands approval''. I signed the paper and that was that. Long story short we purchased a car from another dealership. A month later I am getting credit denials in the mail from banks that say that this other dealership is trying to get us approved for a loan! I have received 2 so far and my husband has received 1 and he never signed anything. Is there anything I can do here legally? All these denials for credit can not be good for my credit rating. Please help.

Re: Running a Credit Check without consent

A real quick answer is yes, your credit can be run without your permission, if the person running it was going to finance you or arrange financing. It is logical that someone who MAY loan you money can check your credit. Read the Fair Credir Reporting Act for more details. And yes, a number of INQUIRIES can be bad for your credit, but if they are all around the same time of a major purchase, like a car, most future lenders understand that you may be shopping around.
