Legal Question in Credit and Debt Law in Indiana

Signed over title to car without getting paid in full

I sold a car to a relative, and signed the title over to him, even though he still owed a balance of $200.00. He did return 30 days later and paid an additional $50.00. He now states that since I signed the title over to him, that he does not have to pay the balance of $150.00.

I did not put a lien on the car, nor do I have anything in writing. Can I take him to small claims court?

Thank You,

AHarton

Re: Signed over title to car without getting paid in full

Yes. You will have the burden of proving that he agreed to pay the full amount. Merely signing title over to him does not vary the agreed upon purchase price
