Fair Credit Reporting by a Credit Reporting Agency

The State of Indiana, Dept of Revenue, had sent a letter, over a year ago, to all three credit bureaus requesting the tax lien be removed from our credit reports because it was incorrectly filed. (for myself and my wife). We have since been denied mortgage refinancing because this tax lien had given us a lower credit score from 1 of the 3 reporting agencies. I even had to pay that same agency to obtain a copy of our credit reports to find the lien. Can I take any recourse against the credit reporting agency for incorrectly reporting our credit and causing refinance problems and other credit problems?

I suggest you hire an attorney who specializes in FCRA violations.At the very least, you can write each credit bureau and dispute the debt. They have 30 days to respond and prove the debt or they have to delete it. As to possible damages for failing to incorrectly dellete the IDR claim from your report, you would have to prove you were damaged and that the listing of the debt was erroneous.
