Legal Question in Credit and Debt Law in Indiana

Can wages be garnished if you only earn $60.00 a week?

I purchased a car that turned out to be a lemon around 8 years ago. I could not afford to keep up the repairs so I called the finance company and had them reposess the car.

I was then sued and charged attorneys fees ect until the debt was almost as much as the original loan.

I then became ill and ended up on social security disability. I work part time and earn $7.00 an hour I earn mabe $45.00 to $60.00 a week the lawyer for the finance company requested a garnishment of wages. I sent documentation on my earnings and proof I was on SS and my wages were garnished via a court ruleing. I though I had to earn at least $150.00 before my wages could be garnished.

Has the court and judge violated the law by garnishing my wages? I live in Indiana

Thank you

You are correct, generally if you earn less than $150 (and I think it's $154) a week, then you don't make enough to be garnished. You say you mailed the information? Did you not attend the hearing? If you can, you should go and take that information with you. You should follow up with both the court and the attorney representing the finance company.
