Legal Question in Credit and Debt Law in Indiana

Going to court for the 3rd time

My husband had to go to court a year and a half ago because a guy said he owes him 2900$. The guy that was trying to get this money from my husband did not show up at the court date. The courts scheduled another date a few months later...the guy did not show again. So my husband wrote a letter to the judge to have the case dismissed. Never heard anything more, now a year later he gets another court paper to appear in court on the 19th for this. How can they do that? How many chances can this guy get? He has no proof because my husband doesn't owe him that money. It was for the guys daughter...long story.. but I don't understand how the courts do this for the 3rd time after it was dismissed??? Can you please help????

Unless a motion to dismiss was filed and served on the Plaintiff, the court has nothing before it to rule upon. I suggest hiring an attorney to try to get this resolved quickly and inexpensively
