Check Cashed without permission

I sent a check to someone that I told them I would send on June 28, 2011. However, after realizing that the check was forwarded to a different address and that he would not receive it for a week or two, I asked him to NOT cash/deposit the check and I would send him the money via Western Union, to which he agreed - via text messages. I sent him the money via WU on July 1, 2011, and he acknowledged that he received it and everything was fine. Then, on July 15, I found out that he had cashed the check without my permisson. Is there any recourse for this, since I specifically told him to not cash the check, or am I just out of luck?

You clearly have a right to get your money back. At law, he's committed conversion. First thing to do is send him a certified letter demanding repayment. If no response within 5 days, go see a lawyer.
