Legal Question in Personal Injury in Indiana

My wife and I were out for a walk last may. We spotted a pit bull 2-3 houses away. In a span of 5 seconds or so the dog flew over 2 fences and was coming full speed barking at us. My wife ,who is terrified of dogs tried to jump a chain link fence but caught a finger ripping a tendon. Later on we also had surgery on a shoulder as a result. We had approached the home owner for help on the $400 medicals bills. They offered no help and we did not pursue any longer. But since the surgery our deductibles and co-pays have reached $4000.00.

Do we have any legal rights?

You don't really say that the dog was loose, so this is hard to answer. If the dog was running full speed and was stopped by a chain, or another fence, then it would be hard to see the liaiblity. If the dog was fully loose in a town where dogs must be confined or controlled, you may have a case.

I would definitely sit down with a lawyer in your community to review this. Most lawyers on cases like this will give you a free initial consultation.

Good luck.
