Superior Court is usually divided into three divisions, criminal, civil and small claims. All cases that are not criminal are civil. If the claim is for an injunction or an amount over $6000 that is a plenary matter in Superior Court. Any matter, less than that amount is a small claims case in Superior Court. If the claim that you are filing has the same core of facts as the other case, you probably cannot file a new case.
