garnishment of joint checking & savings acounts

My husband's name was the only one on the garnishment papers from the court papers and on any documents they have sent us. However, our joint savings and checking accounts have been garnished. They have taken all of the money that was in both accounts. Also his weekly pay checkis garnished. If I go to another bank and get a checking account only in my name can they take the money from that account? My name hasn't been on any of their papers.

If you open an account that is just in your name, the bank cannot be garnished. However, you can. if any of the money belongs ot yoru husband, and they garnish you, you must ruthfully tell them that you hold $x that belongs to him. It is extremely rare that a spouse would be garnished as to debts owed or property held for their spouse.
