Do I have a case?

On october 1, 2000, my daughter was involved in a one car accident. She was a passenger. She received a concussion and also a fractured right hand. She still has medical bills piling up, because the insurance company won't do anything. They keep telling her that she needs an affidavit of no insurance. The other girl who was the driver has already received her lost wages for work and her bills are being paid. My daughter now suffers from a bond that won't mend and also post concusive headaches i.e. migranes. Is there anything we can do?

You absolutely have a case. Your daughter has coverage under the drivers insurance for a minimum of $10,000.00 in PIP (Personal Injury Protection) in the state of Kentucky which will pay medical bills and lost wages up to the limits of the policy as proven. Further, she has a claim against the driver for negligence to recover any medical bills, lost wages and pain and suffering damages.
