Legal Question in Personal Injury in Kentucky

Can they force a defendant to travel to another state to testify

I was in an accident Jne 2004, in Kentucky. The other driver was an insurance salesman, was determined to be at fault and had only liability on his brand new car. He is suing me. My insurance company hired a lawyer. In December 2004 my husband lost his job and we had ot move to Wyoming. I gave a depositon before moving and was told at that time that since I had a concussion and have no memory of the accident I would not be needed at trial. The court date has been set for January of 2006 and the lawyer wants me to travel to Kentucky. I have 9 children at home and ages 16, 13, 10, 8,7,6,5, 18 months, and 5 months. My husband is a farmer and our income this year has only been about $10,000. We can not afford to travel. Can they force me to go to Kentucky for the trial?

For all practical purposes, the attorney hired by your insurance company should be considered by you as your attorney . Thus, this question should really be addressed to him/her. The answer to your underlying question is that you probably will not need to return.
