Trespassing on my rental property under construction

I own rental property that was under construction last summer. Last June, there were people working on the air conditioning & had all the vent covers off while they were fixing the air conditioning. An elderly gentleman who was walking down the street decided to trespass on my property and enter the home. According to the men working on the air conditioning, they stated that this elderly men slipped and fell into the open vent. This gentlemen was hospitalized and later died. I have just been served with papers, which state that the elderly gentlemens son is trying to sue me. This man trespassed onto property that was under contruction and know one was living there at the time. What I would like to know is if he has a case against me?

The real question in a situation like this is not "does he have a case," but rather "do I have a good defense?" If you have not already done so, you should immediately contact your insurance company. This is why you pay premiums.
