Legal Question in Personal Injury in Kentucky

harrassment in my yard by pit bull dog over a period of 4 months

my neighbors dog-pit bull-has been chasing me around in my yard-scaring me and I have called the sheriff 3or 4 times and they have come out and talked to the man each event.finally my husband shot it. It was in our driveway trying to get in the kennel with our golden retriever.it turned on my husband and he shot it. the man next door had been violent with me before and so my husband called the deputy to come and tell the man his dog was dead--he made a terroristic threat to kill my husband and was arrested and then let go. the county att. has a case against him now and we are going to court this week. The man has a lawyer but we don't and I don't understand exactly what's going on-the supoena says it's a bench trial.

It appears that your neighbor has probably been charged with the crime of terroristic threatening and has waived his right to a jury trial. The case is set to be heard by the judge along (based on what your post says). You need not worry about having a lawyer for yourself there: the case is a criminal prosecution if I understand you correctly and the county attorney is the prosecuting attorney. It is his or her job to present the evidence that your neighbor committed a crime if a trial occurs. You will likely be asked to testify as witnesses.

That said, most cases like these are settled without a trial. Most prosecutors will talk to the victims of the crime before reaching a final settlement of the case in order to get their input on the resolution.
