Legal Question in Business Law in Louisiana
For my job as a counselor at a mental health rehab we have to go through over a week of paid training before we can start working with the children. If we do not work for the company for at least one year then our boss takes about 14,000 out of our last few check to pay for training. The nature of the job is so intense that I have only known four employees to work there over a year. Most people quit after two to three months. I've worked there 7 months and have just put in my resignation. The reason I am leaving is that my own psychiatrist told me the stress of my job was too much for my anxiety disorder. Is she allowed to take back the money I've earned through training?

Dear LawGuru Friend,
Your statement of facts is shocking,
event to this old retired lawyer who has
been at it for over 41 years and has hear
about everything. Something here smells,
to use a bit of metaphor. My first answer
would be to say no, but then a lot depends
on the contact you signed when you went
work, and on facts that do not appear from
your short question. If you would care to do
so, I invite you to e-mail me your name and
phone number, and I shall call you and
discuss this very interesting labor law,
employment and contact situation. Of
course, there is no charge for my discussing
this matter with you further. My e-mail address
is [email protected] or hmparkerson@
bigfoot.com.
Wishing you the best, and awaiting your return
e-mail--should you so desire--I am
Sincerely,
Hardy Parkerson, J.D.
Retired Lawyer (for a while, anyway)
Tulane Law, Class of 1966
Lake Charles, LA
P.S.: If you are indeed ready to give it up,
I have a suggestion as to how you might
go about doing so so as to protect your
legal rights and avoid the horrendous penalty
that the employer may try to charge you for
terminating your employment. HMP, JD
