Community Property

Both of us have adult children from a previous marriage. I am prepared to ask an attorney to prepare a will stating that my share of the community property be divided within one year after my demise.

Will the law, regardless of my will to the contrary, permit my husband usufruct of my share of the community property?

Your surviving spouse has a legal usufruct over the portion of your estate which is community property. He can renounce the usufruct.
