Legal Question in Civil Litigation in Louisiana

My date wrecked my car on dec 5, 2004

On December 5, 2004, I was involved in a car accident that left my car not driveable, while I was on a date. My date, the driver, ran a red light and another car hit us. He claims he can pay for the repairs, rental car, and towing fees in January when he gets his student loans. Currently, I am left with no way to work and climbing credit card charges for the car I rented last week. My question is, should I sue him now? Or have him sign a notarized statement that outlines all the charges he is responsible for? I am worried that come January he may have an excuse for not having the $3500+ it will take to get my car repaired. He also has no insurance and I only have liability, which is why the money for the rental is coming out of my pocket. Please let me know the appropriate steps to take to avoid being stuck with all the bills and to ensure this matter can be resolved as quickly as possible.

Unless you have tremendous faith in the driver (and I doubt that because you posted the question) I suggest that you consult with a lawyer.
