Legal Question in Credit and Debt Law in Maryland

Disputing a debt

I had a credit card acct. I made one payment, but never received the merchandise that was charged to the account. I disputed it with the creditor and they did not like what I wrote, so I was asked to dispute it again, using different terms. I submitted another dispute. I received a letter back stating that they were investigating and I would hear back from them. I never did, and instead received a letter from a collection agency. I contacted them and told them I am disputing, and they told me that I could not dispute it because I had already made one payment to the original creditor. I wrote them a dispute letter anyway. I then received a letter from an atty. I called the atty and explained the situation. I sent them all of the communication between me and the original creditor and collection agency. The attorney had the collection agency mark the account as disputed. The original creditor still reports that account as sold, charge off for bad debt on my credit report. I requested the credit bureau investigate and submitted my documentation. I received a letter back stating they could not accept my documentation and the rating stood. How can I have the account properly labled as disputed on my credit report?

Re: Disputing a debt

It appears you did everything correct including disputing the matter on your credit report. The credit reporting agencies have a limited amount of time to investigate and respond to you. If they don't they are in violation of the Fair Credit Reporting Act.

If you want to discuss your rights under the act and how to present the letter to the credit reporting agencies, please contact me for an appointment.
