Taking a substantial step toward the commission of any crime is the crime of attempt. An intentional killing is second degree murder, and a planned killing is first degree. Second degree carries thirty years, and first degree carries life and in some cases the death penalty. An example of second degree would be getting in to a physical fight then taking it to the point of trying to kill the other person. An example of first degree would be hiring a hit man.
