You are possibly subject to enhanced penalties increasing the amount of maximum jail time possible. In all likelihood there would be actual jail time if you were found guilty, but probably not the maximum.
You should immediately contact a criminal defense attorney with experience in DUI because there are many rights you have in a case like this, and they are time sensitive.

Penalties double for a second offense. 2 years in jail/ $2,000.00 fine. Plus, you cannot get probation before judgment. That means the motor vehicle administration will give you 12 points, which revokes your license. You should not go to court alone. Talk to a criminal attorney, like myself, for representation.
