Legal Question in Family Law in Maryland

Thank you in advance for this service. I live in PG, MD I�ve been unemployed for almost 2 years. My husband of 16 years is letting our residence go into foreclosure. He says if I want to stay here I need to figure out a way because he�s made arrangements. We have a 10yo developmentally delayed daughter. He says if I want her I can take her or he would take her. I don�t want him taking her because he has a pornography addiction, we have been in separate rooms for 3 years. He also wants my things out of the house during the short sale process and he�s also having me do curb appeal to the front of the property. What are my rights or what are his responsibilities in this matter? Can I get support without divorce/separation paperwork in place? Do I have any rights to monies from the property which is in his name only, but he bought while married. My brother has offered me a place to go. Thank you very much.

The first thing you need to do is seek assistance through the Prince George's County Bar Association's pro bono legal services program. You will be able to meet free of charge with an attorney who should have some experience in family law. They will also represent you at no cost for fees if you income qualify. To answer your questions, you can file a petition for custody and child support from your husband. You may wish to take advantage of your brother's generousity as far as moving before you do this. You definitely have a marital interest in any equity in the family home notwithstanding that you name isn't on the deed, although it sounds like there won't be much equity if the house is going to a short sale.
