Child custody/leaving the state.

My ex-boyfriend and I have a child together that is 18 months old. We have a temporary agreement in place until September for visitation. He is an alcoholic that drinks every day until he passes out which is usually before our child goes to sleep. He also feels that he can drink and drive with our child. I do not want him to have any visitation rights and I am willing to leave the state and not give him any notice. What could happen to me legally if he finds me in another state?

Re: Child custody/leaving the state.

Since you do not have court-ordered visitation or even a legal order for custody, there is nothing legally preventing you from moving elsewhere with the child. You should go to court and get legal custody, an order for child support, and a ruling that he is not entitled to unsupervised visitation. If you move to another state, you will have to wait 6 months before that state can entertain a custody petition.
