I have a court tomrrow for child custody and child support my husband lives in nj and me in md and he did not show for the first court date and told me he is not comming for this one either but he knows about it what happens in court? He did not request for prologment and told me he never got a letter but I have proof he chose not to come. I also have a life restraining order on him I got in nj . My daughter is 8 months old and I have been struggling because I have a situation with my papers also. He used to be a solider and got discharged for non compliance . I was wondering what happens will I be granted custody so I an move on with my child or is the jugde going to make us wait more?

It depends. But you should DEFINITELY ask the judge to enter a "default" against the father for not showing up. In legal terms, this means you basically win and will get full custody of the kids. Try to explain to the judge that you've spoken with the father and he's indicated that he will not show up and to extend this thing is only to postpone the inevitable. Of course, hiring a family law attorney to represent you gives you the best chance of the greatest success in the least amount of time.
