If the judge does grant you custody on the 29th, ask the judge to order a designated time and place for the father to turn your son over to you. Hopefully the judge will firmly instruct the father in open court that he will be held in contempt if he violates the order, leading to possible incarceration. You should also ask the judge about child support, since the father will be obligated to start paying it if you have full custody. If there is not already a petition or order for support filed, you will probably be instructed to file one to start the process.

You should seek the services of a family attorney; if you can't afford one there are programs through your county bar association for either fee or reduced fee attorneys in these cases.
