My son has his father's last name, but he lives with me, does that give more rights than I?

No. If there is no custody order, then the biological parents have equal rights regarding the child. If there is a custody order, then the terms of the order control the rights of the parents.

Absolutely not. If that were the case, then no parent would ever agree to let the child have the other parent's last name.
