FMLA Rules and Regulations

My private sector company that has aleast 500 employees said that I do not qualify for FMLA because there are not 50 employees within a 75 mile radius of where I work. Is that legal?

The FMLA applies to all private employers with 50 or more employees who work 20 or more calendar workweeks within a 75-mile radius. 29 U.S.C. � 2611(4); 29 C.F.R. �� 825.104(a); � 825.111.

Exclusions apply to the above provision. Measurement and application is also relevant. You should discuss this matter with an attorney.
